Case A - Privacy-friendly analytics (recommended)
If the site uses an analytics solution with no tracking cookie and no personal data (e.g. Plausible, Umami, Fathom), no prior consent is required. A sufficient notice:
“This site uses [Plausible/Umami], a privacy-friendly audience measurement solution, with no tracking cookie and no collection of personal data. No information is shared for advertising purposes.”
Case B - Tracking cookies (Google Analytics, advertising pixels…)
If cookies that are not strictly necessary are set, a compliant consent banner is mandatory:
- Clear information on the purposes before any cookies are set;
- Refusing must be as simple as accepting (buttons at the same level);
- No non-essential cookie set before consent;
- Consent stored and renewable, withdrawal possible at any time;
- Cookie lifetime ≤ 13 months, retention of proof of consent.
